Welcome to the Graded Prompts Preview Program!

Thank you for participating in the Graded Prompts Preview Program ("Preview Program"). By accessing preview.gradedprompts.com (the "Preview Site"), you agree to these Preview Program Terms & Conditions ("Preview Terms").

These Preview Terms govern your participation in our pre-launch testing phase. When Graded Prompts officially launches at gradedprompts.com, you will be asked to accept our full Terms of Service.

1. DEFINITIONS

In these Preview Terms:

• "Platform" refers to the Graded Prompts Preview Site at preview.gradedprompts.com
• "We," "Us," "Our" refers to Graded Prompts and its operators
• "You," "Your," "User" refers to any person accessing the Preview Site
• "Prompt" means any AI prompt template, including its title, description, instructions, variables, and example outputs
• "Creator" means a user who uploads or creates Prompts on the Platform
• "Content" means all materials uploaded to or created on the Platform, including Prompts, text, images, and other media

2. WHAT IS THE PREVIEW PROGRAM?

2.1 Purpose

The Preview Program is a pre-launch testing phase designed to:

• Allow prompt creators to begin building their catalog before our public launch
• Test platform functionality including the purchase flow
• Gather feedback to improve the user experience
• Identify and fix issues before production launch

2.2 Preview Environment

You understand and acknowledge that:

• The Preview Site is a test environment and may contain bugs, errors, or incomplete features
• Features may change, be added, or removed without notice
• The Preview Site may experience downtime or interruptions
• Performance may not reflect the final production environment

3. ACCOUNT REGISTRATION & SECURITY

3.1 Eligibility

To participate in the Preview Program, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Have the legal capacity to enter into these Preview Terms

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access at preview@gradedprompts.com

3.3 One Account Per Person

Each person may only create one account. Multiple accounts may result in removal from the Preview Program.

4. PARTICIPANT CATEGORIES

4.1 Prompt Creators

If you are participating as a Prompt Creator, you are invited to:

• Create and upload prompts to build your catalog
• Test the prompt submission and management features
• Provide feedback on the creator experience

Important for Creators:

• Prompts you create during the Preview Program will be carried over to the production site at launch
• You retain all intellectual property rights to your original Prompts (see Section 5)
• You may edit or delete your prompts at any time before and after launch
• During Preview: Testers may "purchase" your prompts for free (using test payments) to help test the platform. This helps generate initial reviews and feedback for your prompts. You will begin earning real revenue once we transition to production.

4.2 Preview Testers

If you are participating as a Preview Tester, you are invited to:

• Browse and explore the marketplace
• Test the purchase flow and user experience
• Provide feedback on the buyer experience

5. INTELLECTUAL PROPERTY RIGHTS

5.1 Your Content

You retain ownership of all original Content you create and upload to the Platform, including your Prompts. By uploading Content, you grant Graded Prompts a non-exclusive, worldwide, royalty-free license to:

• Display your Content on the Platform
• Use your Content for Platform promotion and marketing
• Create thumbnails, previews, and excerpts of your Content

This license terminates when you delete your Content from the Platform, except for copies made by users prior to deletion.

5.2 Platform Content

The Platform itself, including its design, features, code, and branding, is owned by Graded Prompts. You may not copy, modify, or reverse engineer any part of the Platform.

5.3 Creator Warranties

By uploading Content, you represent and warrant that:

• You are the original creator or have the right to upload the Content
• Your Content does not infringe any third-party intellectual property rights
• Your Content does not violate any applicable laws

5.4 Copyright Concerns

If you believe any Content on the Platform infringes your copyright, please contact us at preview@gradedprompts.com with:

• Identification of the copyrighted work
• Identification of the allegedly infringing Content
• Your contact information
• A statement of good faith belief that the use is not authorized

6. PROHIBITED ACTIVITIES & CONTENT

6.1 Prohibited Activities

You agree NOT to:

• Use the Platform for any illegal purpose
• Attempt to gain unauthorized access to any part of the Platform
• Interfere with or disrupt the Platform's operation
• Upload malicious code, viruses, or harmful software
• Scrape, crawl, or use automated tools to extract data from the Platform
• Create multiple accounts or share account credentials
• Harass, abuse, or harm other users
• Attempt to manipulate ratings, reviews, or rankings
• Use the Platform to distribute spam or unsolicited communications
• Impersonate any person or entity

6.2 Prohibited Content

You may NOT upload Content that:

• Is illegal or promotes illegal activities
• Infringes intellectual property rights of others
• Contains malware, viruses, or malicious code
• Is sexually explicit or pornographic
• Depicts or promotes violence or harm
• Is defamatory, harassing, or hateful
• Targets or exploits minors in any way
• Contains personal or private information of others without consent
• Is fraudulent, deceptive, or misleading
• Violates any applicable law or regulation

6.3 Enforcement

We reserve the right to remove any Content and terminate any account that violates these terms, at our sole discretion and without prior notice.

7. TEST PURCHASES - IMPORTANT NOTICE

7.1 No Real Transactions

All purchases made on the Preview Site are TEST TRANSACTIONS.

• We use Stripe Test Mode for payment processing
• No real money will be charged to your payment method
• You may use Stripe's test card numbers for testing
• You will receive full access to the prompt content for test purchases (see Section 7.3 for tester rewards)

7.2 Test Card Information

For testing purchases, you can use these Stripe test card numbers:

Use any future expiry date and any 3-digit CVC.

7.3 Preview Tester Rewards 🎁

Keep the prompts you test! As a thank you for helping us build a better platform, Preview Testers who complete the requirements below will keep all the prompts they purchase during testing, up to $100 in value - completely free!

To qualify, complete the following during the Preview period:

• Create an account and complete your profile
• Make at least 3 test purchases (using Stripe test cards - no real charges)
• Leave at least 3 reviews on prompts you've tested (be honest - we want your genuine opinion, whether positive or constructive criticism!)
• Submit feedback via our feedback form

Bonus: Testers who report verified bugs or provide exceptionally detailed feedback may receive additional rewards at our discretion.

How to participate:

After registering, email preview@gradedprompts.com with subject line "Preview Tester" to confirm your participation and receive testing guidelines.

Conditions:

• You will receive full access to prompts you test-purchase, up to $100 total value
• You must use the same email address during Preview and after launch
• You must email us to confirm participation before the Preview period ends
• Prompts are for personal use and subject to standard license terms
• We reserve the right to modify this rewards program with notice

8. DATA AND CONTENT DURING PREVIEW

8.1 Your Data

• Account information and preferences created during Preview will be retained for production launch
• We may reset certain data (such as test purchase history) before launch
• You can request deletion of your account and data at any time by emailing preview@gradedprompts.com

8.2 Creator Content

• Prompts, descriptions, and examples uploaded during Preview will be preserved for launch
• We recommend using production-quality content as it will go live
• Draft/incomplete prompts can be saved and finalized before launch

8.3 Feedback and Suggestions

Any feedback, suggestions, bug reports, or ideas you provide during the Preview Program:

• May be used by us to improve the platform without compensation
• Will be treated as non-confidential unless explicitly agreed otherwise
• Are greatly appreciated and help us build a better platform!

8.4 Privacy

We collect and process your personal data in accordance with applicable privacy laws. During the Preview Program, we may collect:

• Account information (email, username, profile details)
• Usage data and analytics
• Feedback and bug reports you submit
• Test transaction records

This data is used to operate and improve the Platform. We do not sell your personal data to third parties.

9. DISCLAIMERS & LIMITATION OF LIABILITY

9.1 No Warranties

THE PREVIEW SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We make no guarantees regarding:

• Uptime or availability
• Data preservation (though we intend to preserve your content)
• Feature completeness or accuracy
• Freedom from bugs or errors
• Fitness for any particular purpose

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRADED PROMPTS AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR PARTICIPATION IN THE PREVIEW PROGRAM.

This includes but is not limited to:

• Loss of data or content
• Service interruptions
• Bugs or errors affecting your experience
• Changes to features or functionality
• Loss of profits or revenue
• Any reliance on the Platform

9.3 No Revenue During Preview

• Creators will not earn revenue from test purchases during the Preview Program
• Real sales and payouts will begin only after production launch
• We will notify all participants before transitioning to production mode

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Graded Prompts and its operators, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the Preview Site
• Your Content uploaded to the Platform
• Your violation of these Preview Terms
• Your violation of any third-party rights

11. TIMELINE AND TRANSITION TO PRODUCTION

11.1 Preview Period

• The Preview Program will run until we announce the production launch
• We aim to provide at least 7 days notice before transitioning to production
• You will be notified via email when production launch is imminent

11.2 Transition to Production

When we transition to production:

• The site will move to gradedprompts.com
• You will be asked to accept our full Terms of Service
• Real payment processing will be enabled
• Creators can begin earning revenue from sales
• Preview Tester rewards will be distributed

11.3 Changes Before Launch

We reserve the right to:

• Modify platform features and functionality
• Update pricing structures and fee schedules
• Change or discontinue any aspect of the Preview Program
• Extend or shorten the Preview period

12. PARTICIPANT RESPONSIBILITIES

By participating in the Preview Program, you agree to:

12.1 Provide Honest Feedback

• Report bugs, issues, or problems you encounter
• Share your genuine experience and suggestions
• Complete feedback surveys when requested (optional but appreciated)

12.2 Responsible Testing

• Do not attempt to exploit bugs or vulnerabilities
• Do not use the Preview Site for malicious purposes
• Do not share access credentials with others
• Respect other participants and their content

12.3 Confidentiality (Optional)

While not strictly required, we appreciate if you:

• Don't publicly review or rate the platform during Preview (it's not finished!)
• Share constructive feedback directly with us rather than publicly
• Wait until launch to promote your prompts externally

13. TERMINATION

13.1 Your Right to Leave

You may stop participating in the Preview Program at any time by:

• Simply not using the Preview Site
• Requesting account deletion via preview@gradedprompts.com

13.2 Our Right to Remove Participants

We may remove participants from the Preview Program if they:

• Violate these Preview Terms
• Abuse the platform or other participants
• Attempt to exploit or harm the platform
• Upload prohibited content
• Engage in fraudulent or deceptive behavior

13.3 Effect of Termination

Upon termination:

• Your access to the Preview Site will be revoked
• Your eligibility for Preview Tester rewards may be forfeited
• We may retain or delete your Content at our discretion

14. GENERAL PROVISIONS

14.1 Entire Agreement

These Preview Terms constitute the entire agreement between you and Graded Prompts regarding your participation in the Preview Program.

14.2 Modifications

We may modify these Preview Terms at any time by posting the updated terms on the Preview Site. Continued use after changes constitutes acceptance.

14.3 Severability

If any provision of these Preview Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

14.4 No Waiver

Our failure to enforce any provision of these Preview Terms does not constitute a waiver of that provision.

14.5 Assignment

You may not assign your rights under these Preview Terms. We may assign our rights at any time.
